These Terms of Service (“Terms”) govern your access to and use of the services provided by Alex Bland AI Agency. Please read them carefully. By creating an account or using the Service, you agree to these Terms.

1. Acceptance and Who We Are

Alex Bland AI Agency (“we,” “us,” or “our”) is a sole proprietorship based in Oregon, United States. By creating an account, subscribing, or otherwise using the Service, you (“you” or the “Client”) agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. The Service

We provide an AI-powered virtual receptionist and related communication tools, which may include answering and placing phone calls, missed-call text-back, SMS messaging, appointment booking, lead capture, call transcripts and recordings, analytics, and optional add-on features. Features available to you depend on your subscription tier and any add-ons you select. We may improve, modify, or discontinue features over time.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Subscriptions, Billing, and Fees

The Service is offered on a subscription basis. Subscriptions and add-ons are billed in advance on a recurring (typically monthly) basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Usage and overage. Certain plans include usage allowances (such as call minutes or message volume). Usage beyond your plan's allowance may incur additional fees at the rates disclosed at sign-up or in your dashboard.

Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. Prices may change; we will give reasonable notice of any change before it takes effect.

Late or failed payment. If a charge fails, we may suspend or limit the Service after a grace period until payment is resolved.

5. Cancellation, Refunds, and Account Deletion

You may cancel your subscription at any time from your dashboard or by contacting us. Cancellation stops future renewals; unless required by law or stated otherwise, fees already paid are non-refundable, and you retain access through the end of the current billing period.

You may also request deletion of your account. Upon deletion, we cancel billing, release any phone number assigned to you, and remove your account data after a short grace period (currently 30 days), as described in our Privacy Policy.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any law or regulation, or infringe anyone's rights.
  • Send unlawful, fraudulent, harassing, or deceptive calls or messages.
  • Engage in unsolicited bulk messaging or calling that violates anti-spam or telemarketing laws.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
  • Resell or provide the Service to third parties except as we expressly permit.

We may suspend or terminate accounts that violate these rules or that create legal or security risk.

7. Your Responsibilities and Compliance

You are responsible for how you use the Service to communicate with your own callers and contacts. In particular, you are responsible for complying with all applicable laws governing calls, recordings, and text messages, including the Telephone Consumer Protection Act (TCPA) and state call-recording and consent laws. This includes disclosing that calls may be recorded where required and obtaining any necessary consent before contacting individuals by text. As described in our Privacy Policy, you are the controller of your callers' data and we process it on your behalf and on your instructions.

8. Third-Party Services

The Service relies on third-party providers (for example, for telephony, messaging, payments, hosting, and AI). Your use of the Service may also be subject to those providers' terms. We are not responsible for the acts, omissions, or availability of third-party services outside our control.

9. AI Disclaimer

The Service uses artificial intelligence to handle conversations, generate transcripts, and take actions such as booking appointments. AI can make mistakes, misunderstand callers, or produce inaccurate information. The Service is provided as a business tool and is not a substitute for professional, legal, medical, or emergency services. It must not be relied upon for emergencies. You are responsible for reviewing AI output and for decisions made based on it.

10. Intellectual Property

We retain all rights, title, and interest in the Service, including its software, design, and content. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of the data you and your callers provide; you grant us the rights needed to host and process that data in order to provide the Service.

11. Service Availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance or due to factors outside our control, including third-party provider outages.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Alex Bland AI Agency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Alex Bland AI Agency from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any law — including laws governing calls, recordings, and text messages to your callers.

15. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Oregon, and you consent to their jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide notice through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
